By accessing or using Kikasha ("the Platform"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our platform.

2. Platform Independence

Kikasha is an independent technology platform and is not affiliated with, endorsed by, or acting on behalf of any government, government agency, political party, elected official, or public institution unless expressly stated.

3. Description of Service

Kikasha is a governance engagement platform that allows users to:

  • Create and participate in posts, forums, polls, and petitions
  • Rate government services and representatives
  • Join virtual meetings and assemblies
  • Follow tags and topics of interest
  • Interact with other users through comments and discussions
  • Track campaign promises and development projects
  • Submit reports, feedback, and allegations regarding public services

4. User Accounts

To access certain features of the platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • Be at least 18 years old or have parental consent to use the platform
  • Not create multiple accounts for disruptive purposes

5. User Conduct and Content

You are solely responsible for the content you post, share, or otherwise make available on Kikasha. You agree not to:

  • Post illegal, defamatory, discriminatory, or harassing content
  • Impersonate any person or entity
  • Post false or misleading information
  • Share someone's personal information without consent (doxxing)
  • Use the platform to spam or promote unrelated products/services
  • Post content that infringes on intellectual property rights
  • Use automated systems to access or scrape the platform
  • Interfere with the proper functioning of the platform
  • Post content that incites violence, hatred, or discrimination

6. User-Generated Content and Liability

Users are solely responsible for the accuracy and legality of any statements, allegations, ratings, reviews, comments, reports, or opinions they publish on Kikasha. Kikasha does not verify, endorse, or guarantee the accuracy of user-generated content.

Kikasha acts solely as a platform provider and intermediary. We are not responsible for user-generated content and assume no liability for statements, opinions, allegations, ratings, reviews, comments, images, videos, or other materials posted by users.

7. Public Reports and Allegations

Critical: Kikasha provides tools that allow users to submit reports, feedback, ratings, reviews, observations, and allegations regarding public services, projects, institutions, organizations, and individuals. Such submissions are solely the responsibility of the submitting user. Kikasha does not investigate, verify, endorse, or guarantee the accuracy of such content and shall not be liable for any reliance placed upon it. Users agree not to submit false, misleading, defamatory, malicious, or unlawful content.

8. Project Tracker Disclaimer

Project information, milestones, reports, photographs, ratings, and updates displayed on the Platform may originate from users, third parties, or public sources. Kikasha makes no representation regarding their completeness, accuracy, reliability, or timeliness.

Users should independently verify all project information before making decisions based on such content.

9. Representative Ratings and Evaluations

Ratings, reviews, rankings, legislative performance metrics, attendance records, public sentiment indicators, and representative evaluations are provided for informational purposes only and do not constitute factual determinations regarding any individual.

Such content reflects the opinions of individual users and should not be construed as official or verified assessments.

10. Political Neutrality

Kikasha is politically neutral and does not endorse, support, oppose, or promote any political candidate, party, movement, or ideology. Views expressed by users belong solely to those users.

11. Anonymous Posting

Kikasha allows anonymous posting for certain content types. However:

  • Anonymous does not mean untraceable - we may be required to disclose your identity to law enforcement
  • Anonymous posts must still comply with all other terms and conditions
  • We reserve the right to moderate anonymous content
  • Anonymous posting does not exempt you from liability for illegal content

12. Content Moderation and Removal

Kikasha may remove, restrict, edit, suspend, disable, or permanently delete any content, account, feature, forum, assembly, petition, poll, or discussion at its sole discretion, with or without notice and for any reason. This includes but is not limited to:

  • Content that violates these terms
  • Content reported by other users
  • Content that we deem inappropriate for the platform
  • Duplicate or spam content
  • Content that may expose Kikasha to legal liability

13. Takedown Procedure

Any person who believes content violates their rights may submit a takedown request to legal@kikasha.com. Such requests should include:

  • Identification of the specific content in question
  • Explanation of why the content violates rights or these Terms
  • Contact information for follow-up

Kikasha reserves the right to investigate, remove content, and suspend accounts pending review of any takedown request.

14. Intellectual Property

Our Content: The Kikasha platform, including its design, logos, and code, is owned by Kikasha and protected by copyright and other intellectual property laws.

Your Content: You retain ownership of content you post. By posting, you grant Kikasha a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on the platform.

Third-Party Content: Content posted by other users remains their property. Do not copy or repost without permission.

15. Data Sovereignty and Processing

By using the Platform, users consent to the collection, storage, processing, analysis, aggregation, and display of data in accordance with the Privacy Policy.

Users acknowledge and consent to Kikasha's use of automated systems, analytics, machine learning, artificial intelligence, and statistical tools to improve services and generate aggregated insights.

16. Disclosure of Information

Kikasha may disclose user information where required by law, court order, regulatory request, investigation, protection of public safety, enforcement of these Terms, or protection of Kikasha's rights and interests.

17. Community Guidelines

Users must comply with all Community Guidelines and platform policies published by Kikasha. Such policies form part of these Terms and are incorporated by reference.

18. Paid Features and Subscriptions

Some features of Kikasha may require payment or subscription:

  • Premium tags may require subscription fees
  • All payments are processed through secure third-party payment providers
  • Subscriptions auto-renew unless cancelled before the renewal date
  • Refunds are handled according to our refund policy
  • Prices are subject to change with notice

19. Disclaimer of Warranties

Kikasha is provided "as is" without any warranties, express or implied. We do not guarantee that:

  • The platform will be uninterrupted or error-free
  • Content posted by users is accurate or reliable
  • We will be able to resolve all disputes between users
  • The platform will meet your specific requirements

20. Limitation of Liability

To the maximum extent permitted by law, Kikasha shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

To the fullest extent permitted by law, Kikasha's total liability arising out of or relating to the Platform shall not exceed the greater of:

  • (a) the amount paid by the user to Kikasha during the preceding twelve months; or
  • (b) KES 10,000.

21. Force Majeure

Kikasha shall not be liable for failures caused by events beyond our reasonable control including internet outages, telecommunications failures, cyberattacks, power failures, strikes, natural disasters, government actions, or acts of God.

22. Indemnification

You agree to indemnify and hold Kikasha harmless from any claims, damages, losses, or expenses arising from:

  • Your violation of these terms
  • Your violation of any third-party rights
  • Your content posted on the platform
  • Your use of the platform

23. Dispute Resolution and Mediation

Parties agree to attempt good-faith mediation before commencing legal proceedings. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of Kenyan courts.

24. Class Action Waiver

To the extent permitted by law, users agree to bring any claims against Kikasha in their individual capacity and not as part of a class action or representative proceeding.

25. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that violates these terms or is harmful to other users.

26. Governing Law

These terms shall be governed by the laws of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of Kenyan courts.

27. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via:

  • Email notification
  • Platform notification
  • Notice on our website

Continued use of the platform after changes constitutes acceptance of the modified terms.
